Website Terms of Use: bandura.ai
Template status: Draft v0.1 for founder review. Not approved for use. Owner: Jack Stoneman. Last updated: [DATE]. Effective: [DATE].
1. About these terms
1.1 This website, bandura.ai (the Site), is operated by Bandura Pty Ltd (ACN [PENDING]) trading as Bandura (Bandura, we, us), of Melbourne, Victoria, Australia.
1.2 By using the Site you agree to these terms. If you do not agree, please do not use the Site.
1.3 We may update these terms by posting a revised version with a new effective date. Continued use after that date is acceptance of the revised terms.
2. Information only — not legal advice
2.1 Bandura is a consultancy. We are not a law practice, we hold no Australian practising certificate, and we do not give legal advice.
2.2 Content on the Site, including articles, guides, newsletters, templates, checklists, demonstrations and descriptions of court practice notes, professional obligations or privacy law, is general information and commentary. It is not legal, financial, technical or professional advice, it does not take account of your circumstances, and it does not create a solicitor–client or other professional relationship.
2.3 You should obtain your own legal advice on legal questions, including whether any use of AI complies with the law, court practice notes or orders, or your professional obligations.
2.4 AI and its regulation change quickly. Content may be out of date at the time you read it. We do not undertake to update it.
3. No reliance and no engagement
3.1 You use information on the Site at your own risk and should not rely on it without independent verification.
3.2 Contacting us through the Site, subscribing to our newsletter or downloading material does not engage Bandura or create any obligation on us to act for you. Bandura is engaged only by a signed agreement.
3.3 Please do not send us confidential, privileged or sensitive information (including information about legal matters or clients) through the Site contact form or by unsolicited email. Until we have a written confidentiality agreement in place, we cannot guarantee that information you send will be treated as confidential, although we will handle it with care and in accordance with our Privacy Policy.
4. Intellectual property
4.1 The Site and its content, including text, graphics, logos, templates, code and design, are owned by Bandura or its licensors and are protected by copyright and other intellectual property laws.
4.2 You may view, download and print content for your personal or internal business reference, and share links to it, provided you keep all copyright notices and attribution. You must not otherwise reproduce, republish, adapt, sell or distribute content without our written consent.
4.3 You must not use Site content, or any data extracted from the Site, to train, fine-tune or evaluate a machine learning or AI model, or make it available to others for that purpose, without our written consent.
4.4 "Bandura" and the Bandura logo are trade marks of Bandura Pty Ltd [registered / unregistered — confirm]. Other names and marks belong to their owners.
5. Acceptable use
You must not: use the Site for any unlawful purpose; interfere with its operation or security; attempt to gain unauthorised access to any system; scrape, crawl or harvest content or personal information other than through standard search-engine indexing that respects our robots directives; submit false, misleading or abusive content through our forms; impersonate any person; or introduce malicious code.
6. Third-party links, tools and demonstrations
6.1 The Site may link to third-party websites, tools and services, including AI model providers. We do not control them, do not endorse them unless we say so expressly, and are not responsible for their content, terms or privacy practices. Your use of them is subject to their terms.
6.2 Any demonstrations, examples or AI outputs shown on the Site are illustrative. AI outputs may be inaccurate or fabricated. Do not rely on them.
7. Newsletter
You may subscribe to our newsletter through the Site. We send it using a third-party platform (currently beehiiv). You can unsubscribe at any time using the link in each email. Our Privacy Policy explains how we handle subscriber information.
8. Privacy and analytics
Our Privacy Policy, at bandura.ai/privacy, explains how we collect and handle personal information through the Site. We use Cloudflare Web Analytics, which does not use cookies or track individuals across sites.
9. Availability
We may change, suspend or discontinue any part of the Site at any time without notice. We do not guarantee that the Site will be available, uninterrupted or error-free.
10. Liability
10.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth) or other law that cannot lawfully be excluded. To the extent permitted by law, and where fair and reasonable, our liability for breach of a consumer guarantee in relation to the Site is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
10.2 Subject to clause 10.1, the Site is provided "as is". To the extent permitted by law, we exclude all liability for any loss or damage (including loss of profit, data, business or opportunity, and indirect or consequential loss) arising from your use of, reliance on, or inability to use the Site or its content, however arising. Where liability cannot be excluded but can be limited, it is limited to A$100.
11. Governing law
These terms are governed by the law of Victoria, Australia. You submit to the jurisdiction of the courts of Victoria. The Site is intended for use in Australia; if you access it from elsewhere you are responsible for compliance with local laws.

Drafting notes
- Enforceability. These are "browsewrap" terms accepted by use. Australian courts give limited weight to such terms for anything beyond disclaimers and IP notices. For anything requiring positive agreement (for example gated downloads or a client portal), use a click-through acceptance.
- Not-legal-advice framing (2). The Site will publish commentary on practice notes and professional obligations. The disclaimer helps but does not cure content that reads as advice; keep articles general and avoid "you must" language directed at readers' specific situations. Consider adding a short standing disclaimer footer on article pages that links here.
- "Do not send confidential information" (3.3). Standard for law firms; worth keeping here because the contact form will attract matter-specific enquiries from lawyers.
- AI training restriction (4.3). Enforceability against large crawlers is uncertain, but the clause supports robots.txt and any later complaint. Add corresponding robots directives on the Site.
- Trade mark status (4.4). Confirm whether "Bandura" is or will be registered, and check for conflicts given the name is also a well-known surname in psychology.
- Liability cap (10.2). The nominal A$100 cap is common for free websites. If the Site ever sells anything (course seats, templates), separate sale terms will be needed and the ACL will apply in full.
- Testimonials and claims. Any claimed outcomes on the Site (for example "X% faster") must be substantiated to avoid misleading or deceptive conduct under ACL s 18. Case studies need client consent (MSA clause 8.7).
- Accessibility. Consider a short accessibility statement (WCAG 2.1 AA target) — courts and government clients often ask.
